This is a important notice about Unemployment Benefit extensions by www.labor.state.ny.us.

On July 22, 2010, Congress approved, and the President signed into law legislation to extend the eligibility dates for benefit extensions to November 28, 2010. This means that individuals who exhaust regular unemployment benefits by November 21, 2010, will be eligible for Emergency Unemployment Compensation (EUC), provided they claim their first week of EUC by week ending November 28, 2010. Also, individuals who exhaust their current tier of EUC by week ending November 28, 2010, will be able to move to the next tier.

New York State now provides 67 additional weeks of unemployment benefits, as well as the usual 26 weeks of regular benefits, for a total of 93 weeks of benefits. These benefits may be claimed in the usual manner; and it is not necessary to file a new claim unless the individual is advised to do so.

An additional 67 weeks of unemployment benefits have been approved for claimants who meet certain criteria.

The first 47 weeks fall under the Emergency Unemployment Compensation (EUC) Program, and are known as Emergency Benefits; the last 20 weeks fall under a different program titled the Extended Benefits (EB) Program, and are known as Extended Benefits. It is important to note that each program has its own timeframes and deadlines, and therefore, not all claimants are eligible for the full 47 weeks of Emergency Benefits and the 20 weeks of Extended Benefits.
The extensions are broken down as follows:

Emergency Benefits: Emergency Benefits which are provided under the Emergency Unemployment Compensation (EUC) Program. There are currently three (3) tiers of EUC, providing a total of 47 weeks of Emergency Benefits:

Tier 1 (20 weeks) – to be eligible for Emergency Benefits under Tier 1, an individual must:

* Have filed initial claim for regular unemployment effective on or before Monday, May 17, 2010.
* Exhaust regular benefits on or before the week ending November 21, 2010.
* Start claiming Emergency Benefits on or before week ending November 28, 2010.
* Please note that if you have claimed one or more partial weeks of benefits since the beginning of your original claim or had a break in your claim, your exhaust date may fall after week ending November 21, 2010 and you are ineligible for Emergency Benefits at this time.

Tier 2 (14 weeks) – to be eligible for Emergency Benefits under Tier 2, an individual must:

* Have filed initial claim for regular unemployment effective on or before Monday, January 4, 2010.
* Exhaust all 20 weeks of Tier 1 Emergency Benefits on or before week ending November 28, 2010.
* Please note that if you have claimed one or more partial weeks of benefits since the beginning of your original claim or had a break in your claim, your exhaust date may fall after week ending November 28, 2010 and you are ineligible for Tier 2 Emergency Benefits at this time.

Tier 3 (13 weeks) – to be eligible for Emergency Benefits under Tier 3, an individual must:

* Have filed initial claim for regular unemployment effective on or before Monday, October 5, 2009.
* Exhaust at least 33 weeks of Emergency Benefits (20 weeks Tier 1 and the first 13 weeks of Tier 2) on or before week ending November 28, 2010.
* Please note that if you have claimed one or more partial weeks of benefits since the beginning of your original claim or had a break in your claim, your exhaust date may fall after week ending November 28, 2010 and you are ineligible for Tier 3 Emergency Benefits at this time.

Note: The last payable week of Emergency Benefits is the week ending May 1, 2011.

Extended Benefits: Extended Benefits are provided under the Extended Benefits (EB) Program. There are currently up to 20 weeks of Extended Benefits available. However, to be eligible for any Extended Benefits, the individual must:

* Have filed their initial claim for regular unemployment benefits effective on or before Monday, June 29, 2009.
* Exhaust 26 weeks of regular unemployment benefits and all available Emergency Benefits.
* Start claiming Extended Benefits on or before week ending December 5, 2010.

Note: The last payable week of Extended Benefits is the week ending December 5, 2010.

Individuals who have a claim with New York State, but live in another state that is not in an extended benefit period, are eligible for only 2 weeks of extended benefits (for extended benefits status of other states, see Frequently Asked Questions).

Work search requirements are more stringent for individuals claiming Extended Benefits (see Frequently Asked Questions). However, individuals in training approved by the New York State Department of Labor, are not required to look for work while claiming benefits.
